Re: Non-licensed orthotic activity

Hello all,

I composed a reply to Mr. Gilbrandson, but decided to also share my frustration with a similar incident, played out.

Texas is also a licensure state.  I had a similar incident with a pedorthist providing AFOs which were similarly inadequate or just wrong.  I filed a grievance with the state, it was investigated and adjudicated.  When his site was investigated it was found to have AFOs in the fabrication process.  He was found to be practicing without a license, for the third time (his licensed was also revoked previously).  I was told by the board they had no jurisdiction and could not mete out a punishment as he was not a licensed individual.  They only have authority over licensees.  It was again referred out to the attorney general for prosecution.  If a lawyer is hired it never goes anywhere.  It costs too much to prosecute and a meager settlement is reached with no significant recourse.  He STILL has a pedorthic practice in out great capital.

When I filed my complaint it was over a REAL issue, a misdeed.  I wanted to follow through and asked to be informed as to progress and outcome.  I wanted to testify and put an end to this travesty.  I was told it was in the state’s hands and there was no way to influence the process.  Perhaps I could have created a bigger stink, but I gave up.  He won again.

This just doesn’t seem right.

>Hello all,
>I practice in Illinois, a licensure state and am a licensed, certified practitioner.  Recently, I had one of my diabetic patients come in for diabetic shoes. He told me of a tale in which his Chicago Dr. ordered a particular orthosis for his ulcerated foot. The Dr. provided him with a company that sent a representative to his home, casted and later fit the patient with this orthosis. This was in March, 2014. I could not find any information on this representative as a licensed orthotist in the State of Illinois. Needless to say, the patient had difficulties with the fit and according to the patient, the rep is no where to be found. (surprise, surprise). The fit problems preclude him using this orthosis. My question to those in Illinois is do we have any recourse on this representative or the company he represents? (I was given this info by the patient).
>I have agreed to help the patient by working with the fabricator to remake the orthosis, with no financial payment  to me.( the Rep’s company has billed for the orthosis) However, this guy’s wound continues to get larger, and he is relegated to a wheelchair. I’m afraid he may ultimately loose the foot.
