necessity of perscriptions

Dear List,


  In regard to the question posed below about needing a Rx for providing a prosthesis for a cash patient, I would say yes, even if Florida law does not dictate it. 


  In the ABC cannons of ethics, section 2.1 states that one is necessary.  As a CP one should follow this, even if the cannons are not inforced by the organization.


  Secondly, as a prosthetist providing a service to a customer and patient (client), you are not providing him the complete service that is necessary.  Should the past need of prosthesis ever be needed in a legal proceeding, all of your notes (Rx is part of this) is necessary and property of the patient that is incorporated with your service.  By not doing this, you are unnecessarily jeapordizing your customer.  Even if one is not in litigation at this point, you never know what the future holds for your customers, so please do not jeapordize it.


  Finally, you are costing your patient the sales tax and income tax benefits.  With a Rx, a prescription is not taxable for sales tax (at least in California) and also it becomes a medical device that one can write off from income taxes.  I am not a CPA, so consult your tax accountant before doing so.  However, I have been told this.


  These are my views, and I am open and willing to hear opposing viewpoints, rational, and ideas.
