Question about the Fraud

This is in the form of a question,

Is it not true that an individual can legally provide an orthotic or prosthetic service to anyone that may desire such services with out a doctor’s prescription and with out the said individual having any credentials, as long as that individual does not call himself Orthotists or Prothetists that person can operate a business. So a person could call himself a “Limb Maker” or a “Brace Maker” or what ever he could come up with and still avoid the health field’s ability to control this problem. So if the above is in fact true then the people that are providing the orthotic or prosthetic services may not be breaking any laws other then providing a bad service, the same way a bad roofer may rip off your grandma. I AM NOT SAYING ITS OK FOR THESE PEOPLE TO BE DOING WHAT THEY ARE DOING, I am just new to the field of O&P and was just wondering if this is at least in part true. If it is, has there ever been anything in the works to close off this little loophole?
