The Office of Inspector General (OIG) of the Department of
Health and Human Services (HHS) has issued an Advisory Opinion
regarding a durable medical equipment (DME) manufacturer’s proposed
arrangement to provide advertising and reimbursement consulting
services to some of its customers. The OIG concluded that the
proposed arrangement could potentially generate prohibited
remuneration under the anti-kickback statute and could potentially
trigger administrative sanctions under the law.
