The Centers for Medicare & Medicaid Services (CMS) published a MedLearn Matters Article to provide instructions on the enforcement of 42 Code of Federal Regulations 424.516 (f)(1) and (f)(2) regarding the maintenance requirements of ordering and certifying documentation. In accordance with the regulation, effective October 1, 2012, durable medical equipment, prosthetics, orthotics, and supplies (DMEPOS) providers must maintain documentation for seven years from the date of service, and upon the request of CMS or a Medicare contractor, provide access to that documentation.
