MIH International, Newark, Delaware, announced that it has filed a patent infringement complaint in the U.S District Court for the District of Delaware against Comfortland Medical, Mebane, North Carolina. The complaint alleges infringement of intellectual property rights relating to MIH’s ActivDay line of back braces.
In addition to claiming financial damage from lost sales, the complaint alleges irreparable damage due to the similarity in appearance between the MIH patented braces and Comfortland’s infringing braces, and due to the inferior construction of Comfortland’s infringing product. The complaint seeks temporary and permanent injunctions against further importation and sales of the Comfortland product in the United States.
