A judge has decided to let stand–at least temporarily–a new
law requiring that Louisiana O&P facilities be accredited in
order to be reimbursed by the state. On January 28, State District
Judge Todd Hernandez dissolved a temporary injunction that was
blocking enforcement of the law, and at the same time set a March
19 trial date for a lawsuit that challenges the law’s
constitutionality. The law was passed on July 23, 2008, and was put
into effect on January 1, long before the September 20 Medicare
national accreditation deadline.
