According to the Memphis Daily News, NewGen Advanced Orthotics Lab, Cordova, Tennessee is working to retrieve more than $600,000 seized by the federal government from its banks accounts. The money was seized in an August 20 operation that also drew approximately $89,000 from the account of Stat Diagnostics, also of Cordova.
Attorney Leslie Ballin, who represents both NewGen and Stat Diagnostics, was quoted by memphisdailynews.com as asserting in a motion filed in Memphis federal court that “there is no probable cause to believe that all or part of the property would be subject to forfeiture.” The motion requested that the money be returned and that sealed affidavits and a sealed warrant relating to the case be opened. Ballin also stated that the freezing of assets would create substantial hardship to the business and that his clients had pre-indictment right of access to the sealed affidavits.
