Otto Bock HealthCare, Duderstadt, Germany, and Otto Bock HealthCare, Minneapolis, Minnesota (collectively, Otto Bock), and Össur, Reykjavik, Iceland, and Össur Americas, Foothill Ranch, California (collectively, Össur), announced that Otto Bock and Össur have entered into a confidential settlement and cross-license agreement that fully resolves the lawsuit and the inter partes review proceeding pending between the parties, both of which relate to U.S. Patent No. 6,726,726.
Otto Bock had filed the original lawsuit on June 12, 2013, in the U.S. District Court for the Central District of California, alleging patent infringement and breach of settlement regarding patented technology incorporated into Otto Bock’s Harmony and Triton Harmony vacuum systems. The district court denied Otto Bock’s motion on August 22, 2013. On February 18, the U.S. Court of Appeals for the Federal Circuit affirmed a lower court’s decision to allow Össur to continue producing prostheses in the face of a competitor’s patent infringement allegations. The current agreement between the parties resolves these proceedings.
